“Good Faith” Management Business Law and Ethics
Read Case 27-3,Buckeye Check Cashing, Inc. v. Camp et al., on page 595,(link to full decision: http://caselaw.findlaw.com/oh-court-of-appeals/1063725.html) and discuss the following: The defendants in this case were both Camp and Sheth. The appellate court reversed the trial court. This case rested entirely upon the definition of “good faith.” One of your classmates believes the term “good faith” as defined by the UCC is too ambiguous for a court to make an informed ruling. Do you agree with your classmate? Why or why not? You are a key administrator for a check cashing company. What policies would you recommend be put in place to prevent this from happening to your company? What do you think about these types of businesses? Are they good for the public, or do they take advantage of the poor?
