Legal Aspects of Project ProcurementProject Procurement Management takes place within a legal framework with which Project Managers must be familiar. Any purchase involves a contract of some complexity, so Project Managers must have a basic understanding of how an offer to buy, an acceptance of the offer, and agreement to specific terms combine to create a purchase contract. Depending upon the industry and type of items or services being procured, the Project Manager will need to understand if the FAR (Federal Acquisition Regulations), Uniform Commercial Code (UCC), and warranties apply. This is referred to as “source selection” and it involves a number of steps, including identifying potential vendors, submitting Requests for Quote (RFQ’s) or Requests for Proposal (RFP’s) to them, depending on what is being procured, evaluating the resulting quotes and/or proposals, evaluating the capability of competing suppliers to meet commitments, and then selecting and contracting with selected suppliers.
